Terms of Service

The Site provides information about Ikonic Marketing’s performance marketing services for independent car dealerships, including advertising, our AI SMS setter, database revival, and website and AEO work. The Site is informational. Any engagement for paid services is governed by a separate written agreement between you and Ikonic Marketing, which controls in the event of any conflict with these Terms.

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that any information you provide is accurate.

You agree not to:

• ►Use the Site for any unlawful purpose or in violation of these Terms.
• ►Attempt to gain unauthorized access to the Site, its systems, or related infrastructure.
• ►Interfere with or disrupt the integrity or performance of the Site.
• ►Scrape, copy, or republish Site content except as permitted by law or with our written consent.

The Site and its content, including text, graphics, logos, designs, and software, are owned by Ikonic Marketing or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to view the Site for your own informational use. You may not reproduce, distribute, or create derivative works from our content without our written permission.

When you book a demo or submit your contact information, you agree that we may contact you by email and by phone about your request and our services. We do not send text messages to prospects, and submitting your number here does not sign you up for texts of any kind.

Text messages to dealership staff are a separate program with its own opt-in inside the Ikonic portal, and giving us your number here never enrolls you in it. Our communications are described in our Privacy Policy, and the staff program in full in our SMS Terms. Staff can opt out of that program at any time by replying STOP.

Any statistics, figures, examples, or projected outcomes shown on the Site, including illustrative funnels and industry benchmarks, are for general informational purposes only. Industry statistics are drawn from third-party sources and reflect those sources, not a promise of your results. Marketing performance depends on many factors outside our control, including your market, inventory, offers, pricing, and sales process. We do not guarantee any specific number of leads, appointments, sales, or revenue.

The Site relies on and links to third-party services and websites that we do not control, including analytics, advertising, scheduling, and hosting providers. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk.

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Ikonic Marketing and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages.

You agree to indemnify and hold harmless Ikonic Marketing from any claims, damages, liabilities, and expenses arising out of your use of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
